APPLICANT SITUATION

The Applicant’s Situation

The applicant had changed employers shortly before applying, meaning current and recent employment details both needed to be represented accurately.

INITIAL ASSESSMENT

What the Assessment Identified

The initial review found a risk that the DS-160 and the applicant’s spoken account of their employment history could describe the timeline slightly differently if not carefully aligned.

FOCUS AREA

Key Focus of This Case

Making sure the DS-160 employment details and the applicant’s verbal explanation of the job change matched exactly.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Reviewed the employment timeline in detail before completing the DS-160
  • Completed and reviewed the DS-160 form for accurate current and recent employment details
  • Conducted mock interview practice on explaining the recent job change
  • Checked that the spoken explanation matched the form exactly
EVIDENCE CONSIDERED

Evidence and Documentation Considered

This case centered on the DS-160 form and interview preparation rather than an extensive supporting-document package, consistent with how B1/B2 visitor visa applications are typically assessed.

PROCESS STAGE

Where This Case Reached

The DS-160 was completed and reviewed, and interview preparation addressing the recent job change was conducted.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

This case illustrates why any recent change in personal circumstances needs to be reflected identically on the form and in the applicant’s spoken answers. See the IndoWorld Evidence Integrity Framework for more on this reasoning.

Recent job changes are a common source of DS-160 inconsistencies, so our DS-160 form guide is worth reading before you fill in employment history. The full B1/B2 route is on the USA visitor visa page, with remote support for Gujarat applicants on our USA visitor visa consultant Gujarat page.

OFFICIAL GUIDANCE

What the Official Guidance Says an Applicant Like This Must Show

This is general guidance for a B-1/B-2 visitor (tourist and business) visa applicant who has recently changed jobs. It is not a detail of the case above.

  • The DS-160 is signed electronically as a statement under penalty of perjury, which is why the employment history on the form needs to be exact (22 CFR 41.103).
  • Fraud or wilful misrepresentation of a material fact to obtain a visa is a separate ground of ineligibility, distinct from 214(b) (INA 212(a)(6)(C)(i)).
  • The core tests remain a residence abroad not being abandoned, a temporary stay and a legitimate purpose (9 FAM 402.2-2); a job change does not alter those tests.
  • The Department’s ties wording lists professional, work, school, family and social links, so a new job sits alongside family and other links rather than standing alone (9 FAM 403.10-3).
  • Officers are told a 214(b) denial must be based on the applicant’s specific circumstances, not on a profile (9 FAM 403.10-3).
  • Residence abroad is defined as the applicant’s principal, actual dwelling place (9 FAM 402.2-2), so the current address and household details also need to agree between the form and the interview.
REFUSAL LETTER

If Your Application Was Refused: What to Look for in the Letter

A letter after a job change may cite ties or may cite something else. Compare it with the ties row and the profile row of the refusal letter wording guide. If your paperwork is a 221(g) sheet rather than a 214(b) letter, the 221(g) row explains how that kind of letter is worded. Our USA visitor visa refusal reasons page and supporting documents page show how employment details and inconsistencies are viewed.

Have a refusal letter in front of you? You can email it to IndoWorld. The experts read the letter and compare it with the application that was refused. The review of a refusal is done at no charge, by video call, phone call or in person at the Vadodara office. See how to get your visitor / tourist visa refusal letter reviewed.
