Canada Family Class – Spouse Permanent Residency
Under Canada’s Immigration and Refugee Protection Act (IRPA s.13(1)) and Immigration and Refugee Protection Regulations (IRPR Part 7), Canadian citizens and permanent residents who meet IRCC’s sponsor requirements can sponsor their legally married spouse or common-law partner for permanent residence in Canada. Unlike a visitor visa or a work permit, a successful sponsorship application leads to permanent resident status, which includes the right to live, work and study in Canada and a path to Canadian citizenship, subject to the usual requirements. Applications are made under two streams: the Family Class (outside Canada, often called “outland”) for spouses living in India or elsewhere abroad, and the Spouse or Common-Law Partner in Canada Class (inland) for couples living together in Canada where the sponsored spouse has valid temporary status. A sponsored spouse in Canada may apply for a spousal open work permit (SOWP) once IRCC has sent an acknowledgement of receipt for the permanent residence application. At IndoWorld Visa & Education Services, we help couples across Vadodara, Ahmedabad, Surat, and the wider Gujarat region prepare for this evidence-heavy process, following the guidance published by Immigration, Refugees and Citizenship Canada (IRCC).
Officers assess the relationship closely. Under IRPR Section 4(1), the relationship must be genuine and must not have been entered into primarily to acquire status in Canada (a “marriage of convenience”), and the marriage must be valid under the law of the place where it took place. In Gujarat, where arranged marriages, cultural ceremonies and extended family celebrations are common, a file usually needs well-organized evidence of the relationship, such as a registered marriage certificate (under the Hindu Marriage Act, 1955, the Special Marriage Act, 1954 or applicable personal law), photographs of the ceremonies (such as saptapadi, varmala and the reception), communication records (WhatsApp logs, call records), and proof of joint travel or living together. A clear, chronological relationship narrative helps the officer follow these proof points and reduces ambiguity.
Unlike economic pathways such as Express Entry or Provincial Nominee Programs, spousal sponsorship does not use Comprehensive Ranking System (CRS) points. In most cases there is no income requirement to sponsor a spouse or partner, but a sponsor who receives social assistance for a reason other than a disability is not eligible, and sponsors who live in Quebec must also meet Quebec’s requirements. The sponsor must sign a 3-year sponsorship undertaking, a commitment to support the sponsored spouse for 3 years from the date they become a permanent resident, which continues even if the relationship changes. Couples frequently assess how temporary status aligns with permanent residence; explore our representative analysis in Assessing an Open Work Permit Alongside a Permanent-Residence Pathway, our case study for a recently married couple applying from India, and our guide on spouses applying from India while the principal applicant is in Canada.
Per Canada.ca — IRCC Spousal Sponsorship eligibility criteria, officers evaluate whether the sponsor is eligible, whether the sponsored person is admissible (including criminal, medical and security checks), and whether the relationship is genuine, before permanent residence is granted. IndoWorld’s Application Intelligence Framework is how we review a file across these points before it is submitted.
Official sponsorship procedures and checklists are governed exclusively by IRCC: consult spousal sponsorship eligibility requirements and how to apply for spousal sponsorship. For current processing times, consult the IRCC processing times tool. The IRCC pages on who you can sponsor and what it means to be a sponsor explain the sponsor and undertaking rules. IndoWorld Visa & Education Services is an independent consultancy. IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. We do not guarantee visa approvals or government processing timeframes.
