APPLICANT SITUATION

The Applicant’s Situation

An Indian worker in Canada had a work permit that was approaching expiry while their spouse wanted to apply.

INITIAL ASSESSMENT

What the Assessment Identified

Timing, remaining authorization and any pending application needed careful assessment. The permit’s length at the start of the job was not the question; its remaining validity at the point of application was.

FOCUS AREA

Key Focus of This Case

Establishing the worker’s actual status and remaining authorization at the time the spouse would apply.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Organized documents to establish the worker’s current status
  • Documented the basis on which the spouse’s application would rest
  • Reviewed the existing permit, its expiry date, the employment evidence and any pending applications under the applicable rules
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • The existing work permit and its expiry date
  • Employment evidence
  • Relevant pending applications
PROCESS STAGE

Where This Case Reached

The case reached the stage of an organized file showing the worker’s actual status and the basis for the spouse’s application, so the timing question could be judged on the facts.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

An approaching expiry can affect both timing and eligibility. The assessment looks at the worker’s actual status instead of assuming that a permit’s original duration still applies. The pending application case covers the situation where a new or extended permit has already been applied for.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. If the timing does not work, the guide on when we would recommend not applying yet explains why waiting can be the more responsible advice.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC’s pages for family members of foreign workers, for a worker whose permit is close to expiry. It does not describe the case above.

  • The 16-month test. For the spouse of a high-skilled worker not on a PR pathway, IRCC’s eligibility page requires the worker’s permit or authorization to be valid for at least 16 months after IRCC receives the spouse’s application, so a permit close to expiry is assessed against that line.
  • Proof of remaining validity. The application page gives as examples a copy of the work permit showing its expiry date, the port of entry letter of introduction, a visitor record showing authorization to work, and passport stamps for people who are work-permit exempt.
  • A spouse’s own permit can be extended. IRCC says a family member in Canada can apply to extend their open work permit if it is valid for a shorter period than the worker’s and they apply before it expires. IRCC states that it cannot issue a permit beyond the expiry of the worker’s permit.
  • The worker’s own extension. IRCC’s page on extending or changing the conditions of a work permit is the starting point for the worker’s side of the timeline.
  • If status is lost. IRCC’s page on restoring status says the expiry date on a work permit is the date work must stop, and that an application to restore status must be received within 90 days of losing status. Family members who also lost status apply separately.
  • Processing times. IRCC’s processing-times tool says an application may take longer than the times shown, so timing should allow for that.
