The principal applicant’s status and the spouse’s eligibility needed to be established. The principal applicant’s presence in Canada was not enough on its own.

Establishing the current status, the relationship and the specific eligibility basis instead of relying on the partner’s presence in Canada.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

Being in Canada does not make a partner’s spouse eligible; what matters is current status, the relationship and the specific basis on which the open work permit is available. The case on a recently married couple looks at the relationship evidence in more detail.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. Where the partner’s status gives the spouse no route, the honest read comes first, followed by the options IRCC describes.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC for a spouse in India whose student or worker partner is already in Canada. It does not describe the case above.

  • Apply from outside Canada through the right option. IRCC’s application page tells an outside-Canada family member to answer “No” to the question about a public policy or special measure, “Yes” to being a spouse, common-law partner or dependent child of a person who has or is applying for a work permit, and to choose “A work permit for a spouse of an international student, or for a family member of a worker”.
  • Timing can differ. IRCC explains on its timing page that a family member who applies separately can apply after the worker (the principal applicant) has applied, even if they would be eligible to apply together.
  • The partner’s application can decide the spouse’s. IRCC says that if the worker’s own application is refused, the family member cannot apply separately and an application made together is refused as well (see how IRCC processes these applications).
  • Entering Canada. For port-of-entry applications IRCC says the principal applicant must enter Canada either before or at the same time as the family members.
  • Show the plan to leave and the funds. IRCC’s outside-Canada work permit page says applicants must show they will leave Canada before the work permit expires and that they have enough money for themselves and any family members.
  • The partner’s own category still matters. For a student partner the program categories on IRCC’s student page apply; for a worker partner the occupation tests on the worker-family page apply.
