APPLICANT SITUATION

The Applicant’s Situation

An Indian applicant planning to seek employment in Germany wanted to understand whether a spouse or children could accompany them.

Family accompaniment depends on the family member’s circumstances and the applicable immigration route; it should not be assumed from the principal applicant’s eligibility alone.

INITIAL ASSESSMENT

What the Assessment Identified

The principal applicant’s route, the family composition, the financial planning and the current official family-reunification guidance were reviewed separately.

FOCUS AREA

Key Focus of This Case

Identifying which family questions needed official verification before travel or filing.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

The Opportunity Card does not automatically resolve the immigration status of every accompanying family member. IndoWorld gives an honest read of which family questions are open before an application is filed, and the decision on every application rests with the German authorities. See the IndoWorld Route-Fit Framework for more on this reasoning.

Our Opportunity Card family members guide covers the topic in more detail, and the proof of funds page covers the financial side.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from the Residence Act and the German Mission in India for an applicant planning for a spouse or children. It does not describe the case above.

  • The card itself. Section 20a of the Residence Act, which creates the Opportunity Card, does not itself set family-reunification rules. It limits employment to an average of 20 hours a week and requires a secured livelihood, which matters for household planning (Residence Act, Section 20a, German text).
  • General family rules. Section 29 sets general conditions for reunification with a foreign national, including the type of residence title held by the person already in Germany and sufficient living space (Residence Act, Section 29, German text).
  • Spouses. Section 30 requires both spouses to be at least 18 and the joining spouse to show basic German, with listed exceptions (Residence Act, Section 30, German text).
  • A partner can apply too. Section 20b lists as a points criterion a spouse or partner who also meets the requirements, applies for an Opportunity Card with the same authority and enters Germany together with the applicant (Residence Act, Section 20b, German text). That is a separate application, not reunification.
  • Mission categories. The mission organises family visas by the status of the person in Germany: dependents of EU Blue Card, ICT or scientist holders use a “dependent” category, others use “family reunion”, and a recognised A1 German certificate is required for most spouses unless the person in Germany holds a high-skilled work visa or permit (German Mission India: joining a spouse or partner; family reunion FAQs). Which category fits an Opportunity Card holder’s family is a question to put to the mission before filing.
  • No promise attaches to the file. The mission states that submitting documents does not mean a visa will be granted, and that incomplete documents or a skipped interview can lead to rejection (German Mission India: joining a spouse or partner).

IF YOUR APPLICATION WAS REFUSED

If your application was refused: what to look for in the letter

If a refusal or rejection letter arrives for the principal applicant or for a family member, check which applicant it names, which visa category it refers to and what reason it gives, and compare that with the category and documents used. The German Mission in India states that the rejection letter already gives the reason, that an applicant may apply again at any time, and that a lawsuit must be filed within one month at the administrative court in Berlin (German Mission India: if a national visa application is rejected). Our what to do after a visa refusal guide covers the general next steps.

Have a refusal letter in front of you? If an earlier visa application of yours, for any country, was refused, you can email the letter and the application documents to IndoWorld. IndoWorld experts read the letter and compare it with the application that was refused. The review can be done by video call, phone call or in person at the Vadodara office, and there is no charge for the review of a refusal. Get your refusal letter reviewed.
