WHAT THIS DEMONSTRATES

What This Case Demonstrates

Prior refusals should not be concealed; assess their stated reasons and the current application on its own facts. IRCC notes that applying again with the same information is unlikely to change a decision, even with a consultant’s help, which is why IndoWorld’s review starts with whether anything has genuinely changed and says so plainly. IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. See the IndoWorld Refusal-to-Remedy Framework for more on this reasoning.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC and Canadian law for an applicant with earlier refusals applying for a Canada visitor visa (the temporary resident visa, often called a tourist visa in everyday use). It does not describe the case above.

  • The form asks. The visitor visa application form asks whether you have ever been refused a visa or permit, denied entry or ordered to leave Canada or any other country or territory, and asks for details if the answer is yes (IRCC form IMM 5257, question 2).
  • Change matters more than repetition. IRCC says whether to apply again depends on why the application was refused and whether the situation has changed, and that applying again with the same information will likely not change the decision (IRCC help centre: should I apply again?).
  • No representative changes that. The same IRCC page says a consultant or agent does not improve the chances or reverse an officer’s earlier decision, and lists examples of changes that may matter, such as a changed reason for visiting or a changed employment or financial situation.
  • Truthful and complete. An applicant must answer truthfully all questions put to them (IRPA section 16), and misrepresenting or withholding material facts is a ground of inadmissibility (IRPA section 40).
  • What the officer decides. The officer must be convinced of ties that will take the applicant home and that they will leave Canada at the end of the visit (IRCC: eligibility; IRPR section 179).
  • Reasons are given. The explanation of a refusal appears in the IRCC account, and most temporary resident refusals now come with an officer decision note (IRCC: officer decision notes).

IF YOUR APPLICATION WAS REFUSED

If your application was refused: what to look for in the letter

Gather every refusal letter, from Canada and from other countries, and read each reason separately. For Canadian letters and officer decision notes, check whether the wording matches the leave-Canada sentence, the purpose sentence, the funds sentence, the origin-of-funds sentence or the family ties sentence. Letters from other countries use different wording; the same wording guide covers the USA, UK, Australia, New Zealand and Schengen. Then compare each stated reason with what is different now. Our Canada visitor visa refusal reasons guide explains the common Canadian grounds.

Have a refusal letter in front of you? Clients email their documents, and the review takes place by video call, phone call or in person at the Vadodara office. There is no charge for the review of a refusal: IndoWorld experts read the letter and compare it with the application that was refused. You can start on the visitor / tourist visa refusal letter review page.
