APPLICANT SITUATION

The Applicant’s Situation

An Indian spouse wanted an open work permit, but their passport was approaching expiry.

INITIAL ASSESSMENT

What the Assessment Identified

The family needed to understand whether passport validity could affect the potential duration of the permit and whether the passport should be renewed first.

FOCUS AREA

Key Focus of This Case

Checking the passport’s remaining validity against the length of permit the family was hoping for.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Checked the identity and immigration documents
  • Considered the timing of passport renewal where appropriate
  • Reviewed the passport expiry, the principal applicant’s circumstances and the applicable duration rules
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • Passport expiry date
  • The principal applicant’s circumstances
  • Applicable permit duration rules
  • Identity and immigration documents
PROCESS STAGE

Where This Case Reached

The case reached the stage of checked identity and immigration documents, with the timing of any passport renewal considered.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

Passport validity can affect permit duration, so the relevant rules should be checked before applying and not after. Renewal timing becomes part of the plan, alongside the principal applicant’s own permit dates. The case on a permit near expiry covers the other side of that timeline.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC’s pages for family members of workers and students. It does not describe the case above.

  • IRCC states the limit. On its eligibility page for family members of foreign workers IRCC says it cannot issue a work permit beyond the expiry of the worker’s permit and of the family member’s passport or biometric validity.
  • IRCC gives a worked example. The page describes a family member whose passport expires before the worker’s permit does. Because a permit cannot be issued beyond the passport’s expiry, they must apply for a new passport and then apply to extend their work permit.
  • A longer passport allows a longer permit. In its example for low-skilled workers’ families, IRCC says a family member who gets a new passport with a later expiry date can apply to extend the work permit to match the worker’s existing authorization.
  • A valid passport goes into the application. The application page lists a photocopy of a valid (not expired) passport or travel document, one photo meeting the specifications and the work permit application form as documents every applicant includes.
  • For student spouses. IRCC says the work permit is, most of the time, valid for the same period as the study permit, and that an extension cannot go beyond the study permit’s expiry (see the student page); the passport’s remaining validity is therefore worth reading alongside the study permit dates.
  • Allow for processing. IRCC’s processing-times tool says an application may take longer than the times shown, which matters when a passport renewal has to come first.
