APPLICANT SITUATION

The Applicant’s Situation

An Indian spouse had received a refusal, and the couple wanted to assess a new application.

INITIAL ASSESSMENT

What the Assessment Identified

The family needed to understand the refusal reasons and whether the current circumstances and evidence met the requirements. Filing the same application again with a new cover letter was not the starting point.

FOCUS AREA

Key Focus of This Case

Reading the refusal letter against the original application before deciding whether a new application is justified.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Reviewed the refusal letter together with the application records
  • Compared the refusal reasons with the current status, program or employment evidence and relationship documents
  • Considered corrections or additional evidence only where the facts justified them
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • The refusal letter
  • The earlier application records
  • Current status
  • Program or employment evidence
  • Relationship documents
PROCESS STAGE

Where This Case Reached

The case reached the stage of an assessment of whether a new application was justified, with corrections or additional evidence considered only where the facts supported them. No outcome is described.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

A new cover letter alone may not resolve an underlying eligibility or evidence problem. The refusal reasons have to be understood first, and a new application makes sense only where something has changed or new evidence answers the reason. The Refusal-to-Remedy Framework and the previous visa refusal preparation guide set out that reasoning.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. The honest read includes saying so when the facts have not changed enough for a new application to be worth filing yet; the guide on when we would recommend not applying yet explains that approach.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance drawn from IRCC’s published pages, for a spouse considering a new open work permit application after a refusal. It does not describe the case above or any particular refusal reason.

  • No formal appeal. IRCC’s help page says that under the Immigration and Refugee Protection Act there is no formal process to appeal decisions on temporary residence applications, and that an applicant who wants a new decision can reapply.
  • Reapply only with a change or new information. The same page says to reapply only if the situation has changed significantly or there is new information that addresses the reason for the earlier refusal. IRCC’s page on applying again adds that an applicant can apply again at any time unless the decision letter says otherwise, and should include information that was not included before.
  • Court review is a separate route. IRCC states that an applicant who believes a decision was unreasonable, or involved an error in law or fairness, can file for leave and judicial review with the Federal Court of Canada. That is a court process, separate from filing a new application.
  • Check eligibility as it stands now. The principal applicant’s study program or occupation and the permit validity have to meet IRCC’s current rules; see the student page and the worker-family page.
  • Keep the new evidence genuine. IRCC lists misrepresentation on an application among the reasons a work permit application may be refused (see its inside-Canada page and outside-Canada page), so anything added to a new file has to be genuine and consistent with the first one.
  • Know the documents IRCC expects. The application page lists relationship proof, proof of the principal applicant’s authorization to work and, for worker families, proof of occupation and remaining validity, and says officers may ask for more.
IF YOUR APPLICATION WAS REFUSED

If your application was refused: what to look for in the letter

If the earlier application was refused, start with the reason stated in the letter and set it beside what was actually submitted. IRCC’s help page says a new application should respond to the reason given, so each sentence of the letter needs a matching answer in the new file. The refusal letter wording guide explains how Canadian officer-note sentences read; its Canada rows come from visitor visa decisions, so they work as a reading aid for a work permit letter and not as an exact match.

Two rows are useful for that purpose. Where a letter says the officer is not satisfied the applicant will leave Canada at the end of the authorized stay, see the leaving Canada row; IRCC’s outside-Canada work permit page asks applicants to show they will leave before the permit expires. Where a letter says documents or funds are insufficient, see the documents row and the assets and financial situation row.

The guide on GCMS notes and ATIP requests explains how officer notes can be requested, and what to do next after a visa refusal lists the steps in order.

Have a refusal letter in front of you? Clients email their documents, and the review takes place by video call, phone call or in person at the Vadodara office. There is no charge for the review of a refusal: IndoWorld experts read the letter and compare it with the application that was refused. You can start on the refusal letter review page.
