WHAT THIS DEMONSTRATES

What This Case Demonstrates

This case shows why incomplete documentation often reflects a checklist gap rather than an unfixable underlying issue. See the IndoWorld Refusal-to-Remedy Framework for more on this reasoning.

Anyone reapplying after an incomplete submission can use our previous visa refusal preparation guide to rebuild the file methodically. The main UK visitor visa page covers the full route, and self-employed applicants across Gujarat can start from our UK visitor visa consultant for Gujarat page.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance drawn from official UK government sources for a self-employed applicant applying for a UK Standard Visitor visa (the visitor / tourist visa) again after an earlier application was treated as lacking evidence. It does not describe the case above.

  • Show the three basics together. The Home Office guide to supporting documents says a visitor must show a permitted activity, that they will leave at the end of the visit, and that they can support themselves and any dependants and pay for the return or onward journey. Tourism is a permitted activity on the Standard Visitor page.
  • Evidence of the business. For circumstances at home, the same guide gives examples such as business registration documents or recent invoices that confirm on-going self-employment, and notes that its list is not exhaustive.
  • Funds, and where they came from. The guide asks for financial documents that clearly show access to the funds, for example bank statements that detail the origin of the funds held. Under Appendix V (V 4.2(e)) any funds relied on must be held in a financial institution permitted under Appendix Finance.
  • Leave out what the guide calls less useful. Its list of documents not to rely on includes bank statements or letters issued more than a year before the application, hotel bookings and flight bookings. Check that list before rebuilding a bundle.
  • Build around the tests, not a document count. The caseworker guidance says the burden of proof is on the applicant, on the balance of probabilities, and that recommended documents are not mandatory: not sending one is not of itself a ground for refusal. A rebuilt file can therefore be organised around the tests (purpose, leaving, funds).
  • Keep the form and the papers aligned. The online application asks, among other things, how much you earn in a year, what you expect the trip to cost and, depending on your circumstances, your travel history for the past 10 years. The caseworker guidance expects declared income to correspond to the evidence supplied.

IF YOUR APPLICATION WAS REFUSED

If your application was refused: what to look for in the letter

If the earlier application was refused for missing evidence, start with the opening sentence about paragraph V 4.2 of Appendix V (see that wording) and then read the reason that follows it. For a self-employed applicant, check whether the letter says the self-employment is settled and established or that statements do not demonstrate the origin of funds. Set each reason beside the documents that were actually submitted, one by one. The wording guide draws its UK sentences from published tribunal decisions, and the UK visitor visa refusal reasons page explains the usual grounds.

Have a refusal letter in front of you? Clients email their documents, and the review takes place by video call, phone call or in person at the Vadodara office. There is no charge for the review of a refusal: IndoWorld experts read the letter and compare it with the application that was refused. You can start on the visitor / tourist visa refusal letter review page.
