APPLICANT SITUATION

The Applicant’s Situation

The applicant had previously applied for a B1/B2 visa, and that earlier application had been placed under administrative processing under Section 221(g) following the interview.

INITIAL ASSESSMENT

What the Assessment Identified

The initial review found that the applicant was uncertain about what to expect in a new interview and wanted to be prepared for possible follow-up questions similar to those raised previously.

FOCUS AREA

Key Focus of This Case

Preparing the applicant for a possible repeat of the earlier questions and for explaining the prior application calmly if asked.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Discussed the earlier interview and any follow-up requests received
  • Reviewed and completed the DS-160 for the new application
  • Conducted mock interview practice including likely follow-up-style questions
  • Practiced a calm, factual way to refer to the earlier application if it came up
EVIDENCE CONSIDERED

Evidence and Documentation Considered

This case centered on the DS-160 form and interview preparation rather than an extensive supporting-document package, consistent with how B1/B2 visitor visa applications are typically assessed.

PROCESS STAGE

Where This Case Reached

The DS-160 was completed and reviewed, and interview preparation addressing the prior administrative processing was conducted.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

This case shows why a prior administrative processing case benefits from specific preparation for likely follow-up questions, rather than generic interview practice. See the IndoWorld Application Intelligence Framework for more on this reasoning.

Applicants whose earlier application went through administrative processing can read our previous visa refusal preparation guide on explaining past history consistently. OFFICIAL GUIDANCE

What the Official Guidance Says an Applicant Like This Must Show

This is general guidance for someone reapplying for a B-1/B-2 visitor (tourist and business) visa after an application placed under section 221(g). It is not a detail of the case above.

  • A 221(g) result is a refusal. The Foreign Affairs Manual describes it as one where the applicant must wait for further administrative processing or respond to a request for documents or information within twelve months of the interview (9 FAM 403.10-3).
  • After the information or clearance result is received, the officer issues or refuses the visa (9 FAM 403.10-4).
  • When a visa is refused, the officer must tell the applicant the ground of refusal and whether a legal mechanism could overcome it (22 CFR 41.121).
  • A new application is still assessed on the same B-1/B-2 tests: a residence abroad that is not being abandoned, a temporary stay and a legitimate purpose (9 FAM 402.2-2).
  • Answers about the earlier application must be accurate, since the DS-160 is signed under penalty of perjury and misrepresentation of a material fact is a separate ground of ineligibility (22 CFR 41.103; INA 212(a)(6)(C)(i)).
REFUSAL LETTER

If Your Application Was Refused: What to Look for in the Letter

A 221(g) sheet often looks different from a 214(b) letter. The 221(g) row of the refusal letter wording guide reproduces the sentence the Department requires about the decision counting as a denial, and explains what the letter may and may not say. If you have both a 221(g) sheet and a later 214(b) letter, compare each with its row. Our USA visitor visa refusal reasons page and processing time page give the wider context.

Have a refusal letter in front of you? You can email it to IndoWorld. The experts read the letter and compare it with the application that was refused. The review of a refusal is done at no charge, by video call, phone call or in person at the Vadodara office. See how to get your visitor / tourist visa refusal letter reviewed.
