APPLICANT SITUATION

The Applicant’s Situation

An Indian student in a professional degree program wanted their spouse to accompany them to Canada with permission to work.

INITIAL ASSESSMENT

What the Assessment Identified

The family needed to confirm that the exact professional program fell within an eligible category. IRCC names professional degrees individually, so the title and level of the program had to be read against that list rather than judged by how professional the course sounds.

FOCUS AREA

Key Focus of This Case

Checking the exact professional program against the specific degrees IRCC names before building the application.

  • Kept the student’s status and the relationship records aligned with the program evidence

Evidence and Documentation Considered

  • Program details
  • Admission or enrolment evidence
  • The student’s status
  • Relationship records
PROCESS STAGE

Where This Case Reached

The case reached the stage of an application organized around the exact program and its supporting evidence. No decision is described here; it rests with IRCC.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

Not every master’s, professional or postgraduate course qualifies, so the exact program has to be checked instead of being assumed from its general type. The master’s student case covers the length-based category, and the skilled worker case covers a spouse whose partner works instead of studies.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. If a program is not on IRCC’s list, that answer is given upfront, with the lawful alternatives described in the case on alternatives when a spouse does not qualify.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC’s page for spouses of international students, for an applicant whose partner is in a professional degree program. It does not describe the case above.

  • IRCC names the degrees. IRCC’s page lists the professional degrees at a university that count: Doctor of Dental Surgery (DDS, DMD), Bachelor of Law or Juris Doctor (LLB, JD, BCL), Doctor of Medicine (MD), Doctor of Optometry (OD), Pharmacy (PharmD, BS, BSc, BPharm), Doctor of Veterinary Medicine (DVM), Bachelor of Science in Nursing (BScN, BSN), Bachelor of Nursing Science (BNSc), Bachelor of Nursing (BN), Bachelor of Education (BEd) and Bachelor of Engineering (BEng, BE, BASc).
  • University level and a valid study permit. The same page ties these degrees to study at a university and requires the student to hold a valid study permit, so the type of school is part of the check.
  • Other programs can qualify as “eligible programs”. IRCC lists specific named programs, for example the Francophone Minority Communities Student Pilot and the Supervised Practice Experience Partnership in Ontario, and asks for proof such as a letter from the province or territory or a DLI acceptance letter showing admission to the program.
  • Show enrolment. One of a valid acceptance letter, a proof of enrolment letter or transcripts from the current program is required, together with proof of the relationship.
  • Use the exact answers in the tool. On IRCC’s application page, an applicant outside Canada is told to choose “A work permit for a spouse of an international student, or for a family member of a worker” when asked what type of work permit to apply for, so the personalized checklist matches the route.
  • If the degree is not listed. IRCC says a spouse who is not eligible for this open work permit may be able to get another type of work permit.
