The Applicant’s Situation
An Indian student in Canada wanted their spouse to join them. Before any form was started, the couple needed to establish whether the student’s exact program qualified under the current rules.
What the Assessment Identified
Not every international student’s spouse qualifies. Eligibility depends on the principal applicant’s program and circumstances, so the first question was which program the student was actually enrolled in, not simply that the student held a study permit.
Key Focus of This Case
Matching the student’s exact master’s program, status and the marital relationship to the categories IRCC publishes.
What IndoWorld Actually Did
- Organized the documents to establish the qualifying program, the student’s status and the marital relationship
- Built the file around the exact program named in the admission and enrolment records
- Presented the program details, study permit and relationship evidence consistently
Evidence and Documentation Considered
- Admission and enrolment documents
- Program details
- The student’s study permit
- Evidence of the marital relationship
Where This Case Reached
The case reached the stage of an organized file that tied the qualifying program, the student’s status and the relationship together. This page does not describe a decision, which rests with IRCC.
What This Case Demonstrates
This case shows that a study permit alone does not establish spouse eligibility; the exact program has to be verified under the current rules before a spouse’s application is built around it. The related cases on spouses of doctoral students and professional-degree students show the other program categories IRCC names.
IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. If a program does not qualify, that is said at the start, together with the other routes IRCC lists, rather than after an application has been filed.
What the official guidance says an applicant like this must show
This is general guidance drawn from IRCC’s published page for the spouse or common-law partner of an international student. It does not describe the case above, and IRCC updates its rules, so the version on the page on the day of application is the one that applies.
- Start with the program category. IRCC’s page for spouses of international students says the student must hold a valid study permit and be studying in a master’s degree program of 16 months or longer, a doctoral program, an eligible program, or one of the listed university professional degrees. The program length shown in the school’s own records is therefore part of the check.
- Prove the enrolment. The same page asks the spouse to provide one of three documents: a valid letter of acceptance from the student’s designated learning institution (DLI), a proof of enrolment letter from the DLI, or transcripts from the current program.
- Add proof of the relationship. IRCC says it will also ask for additional documents, such as proof of the spouse’s relationship to the student. On its application page for worker families, IRCC gives a marriage certificate as an example of relationship proof.
- Expect the permit to follow the study permit. IRCC says that most of the time the spouse’s work permit is valid for the same period as the student’s study permit.
- Use the online tool and the guide. In most cases the spouse applies online, answers questions that produce a personalized document checklist, and is advised to read IRCC’s instruction guide before completing the form.
- If the program does not qualify. IRCC states that a spouse who is not eligible for this open work permit may be able to get another type of work permit; its page on whether you need a work permit is the starting point.
The open work permit does not need a job offer: IRCC’s work permit eligibility page lists it as a permit for special circumstances for which no job offer is required.
