APPLICANT SITUATION

The Applicant’s Situation

An Indian citizen had married someone who was studying or working in Canada, and the couple wanted to apply for the spouse’s open work permit.

INITIAL ASSESSMENT

What the Assessment Identified

The application needed to establish both the relationship and the principal applicant’s eligibility with accurate records. A recent marriage was not treated as a problem in itself, but a marriage certificate alone does not establish every requirement.

FOCUS AREA

Key Focus of This Case

Pairing the relationship evidence with documents that prove the principal applicant’s own eligibility.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Organized the relationship and eligibility documents
  • Checked the documents for consistency
  • Reviewed the marriage certificate, relationship evidence, immigration status and program or employment documents together
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • Marriage certificate
  • Other relationship evidence
  • The principal applicant’s immigration status
  • Program or employment documents
PROCESS STAGE

Where This Case Reached

The case reached the stage of a consistency-checked file that covered the relationship and the principal applicant’s eligibility together.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

A recent marriage is not automatically a problem, but a marriage certificate alone does not establish every requirement. The principal applicant’s eligibility, whether through study or work, has to be proved alongside it. The case on a spouse in India with a partner already in Canada looks at timing and entry.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC for a spouse applying from outside Canada to join a partner who studies or works in Canada. It does not describe the case above.

  • Genuine relationship. IRCC’s eligibility page for worker families says the spouse must be in a genuine relationship with the principal applicant, and its student page asks for proof of the relationship as well.
  • Examples of relationship proof. The application page gives a copy of the marriage certificate and, for common-law partners, the Statutory Declaration of Common-Law Union (IMM 5409) as examples, and says officers may ask for more documents.
  • Prove the partner’s side too. For a student partner IRCC asks for an acceptance letter, proof of enrolment letter or current transcripts. For a worker partner it asks for proof that the worker is or will be authorized to work and for proof of occupation.
  • Basic application documents. The application page lists the work permit application form for applicants outside Canada (IMM 1295), a photocopy of the valid passport or travel document and one photo meeting the specifications.
  • The online checklist. The applicant creates an IRCC online account, answers questions and receives a personalized document checklist; the guide explains each field.
  • Timing between spouses. IRCC says some families can apply together while others must apply separately after the worker has applied, and its timing page has a short question tool to find which applies.
