APPLICANT SITUATION

The Applicant’s Situation

An Indian graduate had a gap between completing a qualification and beginning or returning to professional employment.

The applicant needed to distinguish the effect of the gap from the actual eligibility requirements and supporting evidence.

INITIAL ASSESSMENT

What the Assessment Identified

The education and employment timeline, the current route criteria, the language evidence and the available supporting documents were reviewed.

FOCUS AREA

Key Focus of This Case

Separating what the gap changes about eligibility from what it does not, using the route’s actual requirements.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Reviewed the education and employment timeline against the current route criteria, language evidence and available supporting documents
  • Presented the timeline accurately
  • Included explanations only where the applicant’s own records supported them
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • Education and employment timeline
  • Language evidence
  • Available supporting documents
  • Current route criteria
PROCESS STAGE

Where This Case Reached

An accurate timeline was prepared, with explanations limited to what the applicant’s records supported.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

A gap should be explained honestly, but its significance must be assessed against the actual route requirements. IndoWorld gives an honest read of how a timeline looks against those requirements before an application is filed, and the decision on every application rests with the German authorities. See the IndoWorld Application Intelligence Framework for more on this reasoning.

The Opportunity Card points calculator and eligibility pages show how the criteria fit together, and applicants in Gujarat can start from the Opportunity Card consultant in Gujarat page.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from the German Mission in India and the Residence Act for an Indian graduate whose timeline contains a gap. It does not describe the case above.

  • The CV shows the whole timeline. The mission asks for a CV in English or German listing all prior professional experience, training and qualifications (German Mission India: Opportunity Card), so any gap is visible and has to be presented accurately.
  • Experience is one criterion among several. The Residence Act lists qualification, German and English language skills, related work experience, age, a prior stay in Germany and a qualifying spouse or partner as points criteria (Residence Act, Section 20b, German text). The work-experience criterion looks at related experience within the last seven or five years after the qualification.
  • Language evidence stands on its own. The mission accepts German certificates from recognised providers and English certificates under ALTE standards or TOEFL, and states that Pearson PTE, Duolingo and online TOEFL results are not accepted as proof in India (German Mission India: Opportunity Card).
  • Funds are a separate condition. The card can be issued only if the applicant’s livelihood is secured (Residence Act, Section 20a, German text), and the mission asks for proof of means, for example a blocked account or a formal declaration of support (German Mission India: Opportunity Card).
  • Explanations need records. Applicants must answer truthfully and completely, and knowingly false or incomplete information can lead to refusal (German Mission India: declaration on true and complete information).
  • The score counter helps. The Consular Service Portal questionnaire shows whether the minimum score is reached for the points option (German Mission India: Opportunity Card).

IF YOUR APPLICATION WAS REFUSED

If your application was refused: what to look for in the letter

If a rejection letter refers to your professional history, check whether it concerns a missing period, an unexplained difference between documents or a criterion that was not met, and compare it with what you submitted. A gap explained only by a statement and not by records is the part most worth revisiting. The German Mission in India states that the letter already gives the reason and that a lawsuit against a rejection must be filed within one month at the administrative court in Berlin (German Mission India: if a national visa application is rejected). Our what to do after a visa refusal guide covers the general next steps.

Have a refusal letter in front of you? If an earlier visa application of yours, for any country, was refused, you can email the letter and the application documents to IndoWorld. IndoWorld experts read the letter and compare it with the application that was refused. The review can be done by video call, phone call or in person at the Vadodara office, and there is no charge for the review of a refusal. Get your refusal letter reviewed.
