APPLICANT SITUATION

The Applicant’s Situation

An Indian student was completing studies and was applying for, or had obtained, a post-graduation work permit. Their spouse wanted work authorization.

INITIAL ASSESSMENT

What the Assessment Identified

Eligibility as the spouse of a student and as the spouse of a worker are not interchangeable. The point at which the principal applicant’s status changed therefore decided which set of rules applied.

FOCUS AREA

Key Focus of This Case

Matching the spouse’s application to the principal applicant’s actual status at the relevant time, not to the former student status.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Organized the documents around the principal applicant’s actual status at the relevant time
  • Avoided relying on the former student status alone
  • Reviewed current status, pending permit status, employment circumstances and the applicable spouse rules
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • The principal applicant’s current status
  • The status of the post-graduation work permit, pending or obtained
  • Employment circumstances
  • The spouse rules that apply to that status
PROCESS STAGE

Where This Case Reached

The case reached the stage of an organized file built on the principal applicant’s actual status at the relevant time.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

When the principal applicant’s immigration circumstances change, spouse eligibility has to be reassessed. A spouse who qualified through study does not automatically qualify through a post-graduation work permit. The master’s student case and the skilled worker case show the two sets of rules.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC’s pages for the spouse of an international student who is moving to a post-graduation work permit (PGWP). It does not describe the case above.

  • Two separate routes. IRCC’s student page covers spouses of students in listed programs and its worker-family page covers spouses of workers, so the route has to match the partner’s actual status.
  • A pending PGWP is specifically addressed. Among the situations in which a spouse is not eligible under the high-skilled worker measure, IRCC lists a principal applicant who is applying for a PGWP but has not received a positive decision when the decision on the spousal application is made.
  • Applying with or after the PGWP application. IRCC’s timing page says a family member can apply online with the worker when the PGWP is applied for, if they have arrived in Canada and meet the requirements, or can apply separately after the PGWP application has been submitted.
  • The PGWP decision comes first. The same page says the PGWP must be approved before the family member’s application can be processed, and that the family member’s permit may be refused if no decision has been made on the PGWP by then.
  • Occupation proof. For spouses of PGWP holders, IRCC’s application page asks for proof that the principal applicant is or will be in a TEER 0, TEER 1 or certain TEER 2 or 3 occupation, usually through a letter from the current employer.
  • The student-stream permit is limited by the study permit. Under the student stream, IRCC says an extension cannot go beyond the expiry date of the study permit; IRCC’s PGWP page explains the post-graduation permit itself.
IF YOUR APPLICATION WAS REFUSED

If your application was refused: what to look for in the letter

If a spousal application was refused while the principal applicant’s PGWP was still undecided, look in the letter for a statement about the principal applicant’s status or eligibility, because IRCC’s timing page says the PGWP decision has to come first. IRCC’s help page explains that there is no formal appeal for temporary residence decisions and that a new application should be filed only if the situation has changed or new information addresses the reason for refusal.

The visa refusal letter wording guide explains how Canadian refusal sentences read; the officer-note sentences it reproduces come from visitor visa decisions, so it is a reading aid and not a match for a work permit letter. What to do next after a visa refusal sets out the steps in order.

Have a refusal letter in front of you? Clients email their documents, and the review takes place by video call, phone call or in person at the Vadodara office. There is no charge for the review of a refusal: IndoWorld experts read the letter and compare it with the application that was refused. You can start on the refusal letter review page.
