Canada Spousal Open Work Permit Case: Alternatives When a Spouse Does Not Qualify

A representative case involving a couple who found that the principal applicant’s study or work circumstances might not qualify the spouse, so eligibility had to be assessed before any route was chosen.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

Not every spouse qualifies for an open work permit. Assessing eligibility first, and then explaining lawful alternatives where appropriate, avoids pursuing a route that is not available. The cases on students’ spouses and skilled workers’ spouses show where the main eligibility lines fall.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. This case is the plainest example of an honest read: when a route does not fit, that is said upfront, and no outcome is promised on any route.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC on what to consider when a spouse may not qualify for an open work permit. It does not describe the case above.

  • IRCC says other work permits may be possible. On both its student spouse page and its worker-family page IRCC states that a family member who is not eligible may be able to get another type of work permit.
  • Visiting or studying. The worker-family page adds that a family member who does not plan to work may be eligible to visit or study; see IRCC’s visit and study permit pages.
  • The two main permit types. IRCC explains that an employer-specific permit needs a job offer, while an open work permit needs none but is available only in special circumstances for which the applicant is eligible (see its inside-Canada page); IRCC’s page on whether you need a work permit is the starting point.
  • Free trade agreement workers. IRCC says spouses of workers under certain free trade agreements may be eligible for a spousal open work permit, and that an applicant who is not eligible through an agreement may still be eligible under the family-member measure; see the free trade agreement page.
  • IRCC’s eligibility questions. IRCC’s Help Centre page on open work permits lists the situations in which an open work permit is available and points to a short set of questions for checking eligibility.
  • Rules are tied to the principal applicant. Eligibility on both IRCC pages depends on the principal applicant’s program, occupation and permit validity, so a change in any of them can change the answer.
