Canada Spousal Open Work Permit (SOWP)

A Canada Spousal Open Work Permit (SOWP) is a work permit for the spouse or common-law partner of an eligible international student or skilled foreign worker. It lets the holder work for almost any employer in Canada without an LMIA (Labour Market Impact Assessment), with the limited exceptions IRCC lists. Unlike an employer-specific work permit, an open work permit does not require a job offer and does not tie the holder to one employer.

Under IRCC’s current rules, eligibility depends on the principal applicant’s status. A spouse of an international student can qualify when the student holds a valid study permit and is in a master’s programme of 16 months or longer, a doctoral programme, an eligible programme IRCC lists, or one of the university professional degree programmes IRCC lists (such as medicine, law, engineering or nursing); see IRCC’s guidance for spouses of international students. A spouse of a worker can qualify when the worker holds (or is approved for) a work permit and is employed in a TEER 0 or 1 occupation, or in one of the select TEER 2 or 3 occupations IRCC lists, with a work permit valid for at least 16 months after IRCC receives the spouse’s application; other worker pathways have their own rules, set out in IRCC’s guidance for family members of workers. At IndoWorld Visa & Education Services, we check these prerequisites against IRCC’s published criteria before an application is submitted.

Because an SOWP is a temporary resident application, the officer must be satisfied that the applicant will leave Canada at the end of the authorized stay. Under IRPA Section 22(2) (“dual intent”), an intention to become a permanent resident does not by itself prevent a person from becoming a temporary resident. Applications can run into difficulty when a marriage is recent or when financial evidence is not well organized. Explore our case studies on recently married couples applying from India and reapplication after a previous SOWP refusal.

Our structured evaluation framework includes IndoWorld’s Application Intelligence Framework, Route-Fit Framework, and Document Logic Guide. For full case evidence, review our Canada spousal work permit case library.

Official work permit regulations are administered exclusively by IRCC: consult IRCC’s open work permit rules for family members of workers and IRCC’s open work permit rules for spouses of international students. IndoWorld Visa & Education Services is an independent consultancy. IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. We do not guarantee visa approvals or government processing timeframes.

If a spousal open work permit application was refused, start with the reasons in the refusal letter.
