APPLICANT SITUATION

The Applicant’s Situation

An Indian doctoral student in Canada wanted their spouse to join them. The application had to show two things clearly: the student’s doctoral-study status and the marital relationship.

INITIAL ASSESSMENT

What the Assessment Identified

The application needed to establish doctoral-study status and the marital relationship. Doctoral study is one of the program categories IRCC names, but it still has to be shown through the student’s own records rather than assumed.

FOCUS AREA

Key Focus of This Case

Showing the doctoral program, the study permit and the relationship through records that agree with one another.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Organized supporting documents to explain the student’s status
  • Organized the documents that establish the marital relationship
  • Built the file on the student’s actual program and status, supported by consistent records
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • Doctoral program details
  • Enrolment documents
  • The student’s study permit
  • Relationship records
PROCESS STAGE

Where This Case Reached

The case reached the stage of an organized file in which the program, status and relationship records had been reviewed for eligibility and consistency. No decision is described here; that rests with IRCC.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

Eligibility rests on the student’s actual program and status, supported by consistent records. A doctoral program is a named category on IRCC’s page, which makes the enrolment evidence the central part of the file. The neighbouring cases on master’s students and professional-degree students work through the other categories.

IndoWorld’s guidance follows the guidelines IRCC publishes on its website; the decision on every application rests with IRCC. No outcome is promised on any page in this section, and where a file looks thin the assessment says so before work on an application begins.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance from IRCC’s page for spouses of international students, written for an applicant whose partner is in a doctoral program. It does not describe the case above.

  • Doctoral study is a named category. IRCC’s page for spouses of international students lists a doctoral degree program, together with a valid study permit held by the student, as one of the situations in which a spouse or common-law partner may be eligible.
  • Show the enrolment with a school document. The spouse must provide one of: a valid letter of acceptance from the student’s designated learning institution (DLI), a proof of enrolment letter from the DLI, or transcripts from the current program. Proof of the relationship is requested as well.
  • An open permit means any employer, not a named one. IRCC describes the permit as allowing work for any employer in Canada, apart from employers that IRCC lists as non-compliant or that fall into the excluded categories on that page.
  • Extension follows the study. For an extension under this stream IRCC requires that the student has a valid study permit, is or will be physically in Canada while studying, is a full-time student in a PGWP-eligible program at a DLI and is not in the last term. The extended permit cannot go beyond the expiry of the study permit.
  • Documents for an extension. IRCC asks for proof of full-time enrolment, such as a DLI enrolment letter or transcripts, and a copy of the study permit.
  • Timing. IRCC’s processing-times tool shows current processing times and says an application may take longer than the times shown.
