APPLICANT SITUATION

The Applicant’s Situation

An Indian family planned a US trip where a minor child would travel with only one parent or accompanying adult.

The family needed to plan the child’s documentation and travel circumstances without assuming that the adult’s visa or itinerary answered every question.

INITIAL ASSESSMENT

What the Assessment Identified

The child’s application circumstances, the accompanying adult, the travel plan and any relevant consent or custody documentation were considered according to the facts and the applicable guidance.

FOCUS AREA

Key Focus of This Case

Assessing the minor’s application on its own facts, including who is travelling with the child.

CASE-HANDLING WORK

What IndoWorld Actually Did

  • Organised the family’s travel and relationship records consistently
  • Checked any additional document requirements for the specific circumstances
EVIDENCE CONSIDERED

Evidence and Documentation Considered

  • Details of the accompanying adult and the travel plan

PROCESS STAGE

Where This Case Reached

The family’s travel and relationship records were organised consistently, and the additional document requirements for the specific circumstances were checked.

WHAT THIS DEMONSTRATES

What This Case Demonstrates

A minor’s application should be assessed on its own facts, including who is travelling with the child. IndoWorld gives an honest read of what a family’s documents do and do not cover before applications are filed, and the decision on every application rests with the U.S. consular officer. See the IndoWorld Evidence Integrity Framework for more on this reasoning.

OFFICIAL GUIDANCE

What the official guidance says an applicant like this must show

This is general guidance for a family whose child will travel with one parent or another accompanying adult on a B-1/B-2 visitor (tourist and business) visa. It is not a detail of the case above.

  • The child applies too. Every alien seeking a nonimmigrant visa must make an electronic application on the DS-160, and for a child under 16 a parent or guardian may complete and execute it (22 CFR 41.103). If there is no parent or guardian, a person with legal custody or a legitimate interest may do so (9 FAM 403.2).
  • B-2 covers family visits and tourism. The regulation describes pleasure visits as including tourism and visits with friends or relatives (22 CFR 41.31).
  • Assessed on the child’s own circumstances. A 214(b) decision must rest on the applicant’s specific circumstances (9 FAM 403.10), and the ties listed in the letter template include school and family links.
  • Residence abroad and funds. The Manual requires a residence in a foreign country that the applicant does not intend to abandon, and funding arrangements adequate for the visit (9 FAM 402.2).
  • Travel documents for entry. U.S. Customs and Border Protection’s guide for international visitors advises that, if possible, minors travelling without both parents carry a notarized letter, and that a child accompanied by one parent should have a note from the other parent (CBP: Welcome to the United States). This concerns travel, not the visa application itself.
  • Accuracy. The statements on the form are made under penalty of perjury (22 CFR 41.103), so relationship and custody details must match the family’s documents.

IF YOUR APPLICATION WAS REFUSED

If your application was refused: what to look for in the letter

If a child’s letter is a 214(b) refusal, read it as a decision about that child: the 214(b) ties row and the category row explain the usual sentences, and the profile row explains why the reasoning has to refer to specific circumstances. Compare the reason with the relationship and travel records the family provided. Our USA visitor visa refusal reasons page explains the common grounds.

Have a refusal letter in front of you? Clients email their documents, and the review takes place by video call, phone call or in person at the Vadodara office. There is no charge for the review of a refusal: IndoWorld experts read the letter and compare it with the application that was refused. You can start on the visitor / tourist visa refusal letter review page.
